DailyWavy (dailywavy.com) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. ยง512. This page explains how to report content on our Site that you believe infringes your copyright, and how to respond if your content was removed.
Our content
The articles, text, and images published on DailyWavy are original works created for this Site, or are used with permission. If you believe that any material on DailyWavy infringes a copyright you own or control, please send us a takedown notice as described below and we will act promptly.
How to file a DMCA takedown notice
Email your notice to contact@dailywavy.com with the subject line “DMCA Takedown Request”. To be effective under the DMCA, your notice must include:
- Your full name, mailing address, telephone number, and email address
- Identification of the copyrighted work you claim has been infringed (or a representative list, if multiple works are covered)
- The exact URL(s) of the material on DailyWavy that you claim is infringing, so we can locate it
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf
- Your physical or electronic signature
What happens next
When we receive a valid takedown notice, we will review it and remove or disable access to the material in question, usually within a reasonable time. Where the material was submitted by a third party, we will make a reasonable attempt to notify that party of the removal.
Counter-notification
If your content was removed because of a takedown notice and you believe the removal was a mistake or that you have the right to use the material, you may send us a counter-notification at contact@dailywavy.com with the subject line “DMCA Counter-Notification”. Your counter-notification must include:
- Your full name, mailing address, telephone number, and email address
- Identification of the material that was removed and the URL where it appeared before removal
- A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for any judicial district in which DailyWavy may be found), and that you will accept service of process from the person who filed the original notice
- Your physical or electronic signature
If we receive a valid counter-notification, we may restore the material in accordance with the DMCA unless the original complainant files a court action.
Repeat infringer policy
In appropriate circumstances, DailyWavy will terminate the access of contributors or accounts that are repeat infringers.
Please note
Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. This page is general information about our process, not legal advice. If you are unsure about your rights, consult a qualified attorney.
